The Compulsory Third Party (CTP) scheme together with the Nominal Defendant (the body that looks after accidents when the vheicle at fault is not registered or can’t be indentified) ensures that every person using roads in Queensland is covered by insurance arrangements in the event that they are injured.
This covers motor vehicle owners, drivers, passengers and pedestrians.
It does not automatically provide compensation as it is a ‘fault’ based system. This means that the person seeking compensation must prove to a court that someone else was ‘at fault’ and caused the accident and injuries.
Who pays a CTP claim?
Owners of motor vehicles in Queensland are required to have CTP through their registration. If a claim is successful against the owner of a vehicle their CTP insurance covers the compensation.
In cases where the party at fault is unknown or their vehicle is not insured the State Government’s “Nominal Defendant” pays the claims for the people who have been injured.
